By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Chevalerio.
Chevalerio is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The Chevalerio app stores and processes personal data that you have provided to us, to provide Chevalerio Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Chevalerio app won’t work properly or at all.

You should be aware that there are certain things that Chevalerio will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Chevalerio cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Chevalerio cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Chevalerio cannot accept responsibility.
With respect to Chevalerio’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Chevalerio accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on iOS – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Chevalerio does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
USER ACCOUNTS
In order to use most aspects of the Services, you must register for and maintain an active personal user Services account (“Account”). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account, unless a specific Service permits otherwise. You cannot register for or maintain an Account if you have previously been banned from accessing or using the Services. Account registration requires you to submit to CHEVALERIO certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method supported by CHEVALERIO. For more information regarding CHEVALERIO's use of your personal information, please see our Privacy Notice currently available at PRIVACY POLICY. You agree to maintain accurate, complete, and up-to-date information in your Account, including a valid phone number, address and payment method. Your failure to comply with these Terms (including policies and supplemental terms) including, without limitation, your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by CHEVALERIO in writing, you may only possess one Account.
CHEVALERIO make travel arrangements for individuals, groups and organizations, including scheduling flights and ground transportation, booking accommodations and handling any other trip-related tasks.
CHEVALERIO REQUIREMENTS AND CONDUCTS
You agree to abide by the CHEVALERIO this Terms & Condition and Privacy Policy, available in the app. Failure to comply with our Terms & Conditions and Privacy Policy or any violation of these terms may result in the permanent loss of access to the Services.
The Services are not available for use by persons under the age of 18. You may not authorize third-parties to use your Account, and you may not allow persons under the age of 18 to request or receive our services from Third-Party Providers unless they are accompanied by you. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when accessing or using the Services, and you may only access or use the Services for lawful purposes (e.g., no request for the purpose or intent of transport of unlawful or hazardous materials). You may not in your access or use of the Services cause nuisance, annoyance, inconvenience, or property damage, whether to the Third-Party Provider or any other party. If you request a ride option with a car seat, you acknowledge and agree that neither CHEVALERIO nor the Third-Party Provider is responsible for the safety of a child restraint/car seat that may be available in the Third-Party Provider’s Vehicle. You acknowledge and agree that it is your obligation to ensure that the car seat is installed correctly and that the child is properly secured in the seat. If you request a ride option where a driver agrees to provide you with assistance outside of the vehicle (e.g., CHEVALERIO assist), you acknowledge and agree that neither CHEVALERIO nor the Third-Party Provider is responsible for any injury or incident that may arise out of the assistance provided by the Third-Party Provider. In certain instances, you may be asked to provide proof of age, identity or other method of identity verification to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of age, identity or other method of identity verification.
Subject to the discretion of a Third-Party Provider, you may be allowed to bring a small animal, such as a dog or cat, on a ride requested through the CHEVALERIO Platform. For such trips, you are responsible for properly securing the animal with a leash, harness, crate / carrier, or through other means. You are also responsible for ensuring that the animal does not cause damage or a mess in the Third-Party Provider’s vehicle. You may be subject to a Charge for Repair or Cleaning for any damage or mess caused by an animal that is transported during a ride requested under your Account. Please note, in accordance with CHEVALERIO's policies on Service Animals and assistive devices, Service Animals are generally permitted to accompany riders without extra charge, regardless of whether it is a Pet Friendly Trip.
For the purpose of assisting us with our compliance and insurance obligations, you agree to notify us within 24 hours and provide us with all reasonable information relating to any incident or accident that occurs during your use of the Services and you agree to cooperate with any investigation and attempted resolution of such incident.
TEXT MESSAGING AND TELEPHONE CALLS
You agree that CHEVALERIO., and its subsidiaries, representatives, affiliates, officers and directors, may contact you by telephone or text messages (including by an automatic telephone dialing system and/or with an artificial or pre-recorded voice) at any of the phone numbers provided by you or on your behalf in connection with an CHEVALERIO account, including for marketing purposes. You understand that you are not required to provide this consent as a condition of purchasing any property, goods or services. You also understand that you may opt out of receiving text messages from CHEVALERIO at any time, either by replying “STOP MARKETING”, texting the word “STOP MARKETING” to +1 347-460-3438 using the mobile device that is receiving the messages, or by contacting CHEVALERIO at nyc@chevalerio.com. If you do not choose to opt out, CHEVALERIO may contact you as outlined in its User Privacy Policy, located at PRIVACY POLICY.
You agree that CHEVALERIO may contact you using any of the phone numbers you provided in connection with an CHEVALERIO account (including via text or voice-recorded message) or your email address in the case of suspected fraud or unlawful activity.
PAYMENT
You understand that use of the Services may result in charges to you for the services or goods you receive from CHEVALERIO and/or from Third-Party Providers (“Charges”). CHEVALERIO will enable your payment of the applicable Charges for services or goods obtained through your use of the Services. Charges will include applicable taxes where required by law. Charges may include other applicable fees such as delivery fees, service fees, product return fees, cancellation fees, government-mandated fees (such as bag fees), estimated or actual tolls, and/or surcharges.
All Charges and payments will be enabled by CHEVALERIO using the preferred payment method designated in your Account, after which you will receive a receipt. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that CHEVALERIO may use a secondary payment method in your Account, if available. Charges paid by you are final and non-refundable, unless otherwise determined by CHEVALERIO.
As between you and CHEVALERIO, CHEVALERIO reserves the right to establish or adjust Charges for any or all services or goods obtained through the use of the Services at any time. CHEVALERIO will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Certain users may from time to time receive promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. Promotional offers and discounts are subject to change or withdrawal at any time and without notice. You may elect to cancel your request for Services at any time prior to the commencement of such Services, in which case you may be charged a cancellation fee on a Third-Party Provider’s behalf.
With respect to Third-Party Providers, Charges you incur will be owed directly to Third-Party Providers, and CHEVALERIO will collect payment of those charges from you, on the Third-Party Provider’s behalf as their limited payment collection agent, and payment of the Charges shall be considered the same as payment made directly by you to the Third-Party Provider. In such cases, you retain the right to request lower Charges from a Third-Party Provider for services or goods received by you from such Third-Party Provider at the time you receive such services or goods, and Charges you incur will be owed to the Third-Party Provider. CHEVALERIO will consider in good faith any request from a Third-Party Provider to modify the Charges for a particular service or good. This payment structure is intended to fully compensate a Third-Party Provider, if applicable, for the services or goods obtained in connection with your use of the Services. Except for amounts provided by you through the Application as part of the “tip” feature, CHEVALERIO does not designate any portion of your payment as a tip or gratuity to a Third-Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third-Party Provider who provides you with services or goods obtained through the Service, you are under no obligation to do so. There also may be certain Charges you incur that will be owed and paid directly to CHEVALERIO or its affiliates. For the avoidance of doubt, CHEVALERIO does not charge a fee for a user to access the Platform, but may charge users a fee or any other Charge for accessing Services made available through the Platform. Even if not indicated on the CHEVALERIO Platform, you understand that the prices for product displayed through the Services may differ from the prices offered or published by Third-Party Providers for the same product or menu items and/or from prices available at other third-party websites/mobile applications. Prices for product or menu items displayed through the Services may not be the lowest prices at which the product or menu items are sold. You also understand that product prices displayed through the Services or fees charged by and paid to CHEVALERIO may vary based on whether you choose to pick up your order or have it delivered.
If you think a correction should be made to any Charge you incurred, you must let CHEVALERIO know in writing within 30 days after the Charge took place or CHEVALERIO will have no further responsibility and you waive your right to later dispute the amounts charged.
Payment method is to be established prior to the reservation commencing. Drivers/Chauffeurs are NOT AUTHORIZED to make any changes to client’s reservations under any circumstances, apply or discount charges, or accept any payment other than additional gratuity. All initial charges, fees and discounts are estimated based on standard rates and fees. Additional tolls, parking, stops, after hours, excessive wait time, and other fees may apply. Actual total amount due will be calculated upon completion of the trip.
VEHICLE UPGRADES
CHEVALERIO reserves the right to provide a complimentary vehicle upgrade or, utilize subcontractors or network members, due to events that prevent CHEVALERIO ability to fulfill the reservation request. While CHEVALERIO will make reasonable efforts to provide the specified vehicle requested, CHEVALERIO does not guarantee the year, make, or model due to the variation in vehicle standards.
SMOKING POLICY
All vehicles are maintained to the highest standard of cleanliness and safety. No smoking is permitted at any time inside, near, or around the vehicles.
Damage, Cleaning, Lost and Found, and Violation of Terms.
CHEVALERIO may charge you a fee on behalf of Third-Party Providers if, during your use of the Services, you have caused damage to a vehicle or property that requires repair or cleaning (“Repair” or “Cleaning”). The amount of such fee shall be determined, in CHEVALERIO’s sole discretion, based on the type of damage and the severity. CHEVALERIO reserves the right to verify or otherwise require documentation of damages prior to processing a fee. In the event that a Repair or Cleaning request is verified by CHEVALERIO in CHEVALERIO’s reasonable discretion, CHEVALERIO reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning using your payment method designated in your Account. Such amounts, as well as those pertaining to lost and found goods, will be transferred by CHEVALERIO to a Third-Party Provider, if applicable, and are non-refundable.
Additionally, if you fail to comply with these Terms, you may be responsible for Charges, including without limitation, for transactions that could not be completed properly, arising out of or in connection with your failure to comply with these Terms.
Use of Accounts Owned by Others
In the event you use an CHEVALERIO product or service that enables use of or billing to another person or business, certain information will be shared with that party. This may include information regarding the time and date of services you request, the transportation, logistics and/or delivery requested, and the associated charges for such services. If used to request transportation, we may also share information with such person or business regarding safety-related incidents that occur in connection with such transportation. You acknowledge that such data sharing is a condition of use of any such CHEVALERIO product or service.
CANCELLATION POLICY
For a full refund, cancellation must be made 72 hours prior to time of service. Failure to comply with the deadline will result in the following penalties: All reservation cancelled or modified within 72 hours of time of service are subject to 25% penalty fee, all reservation cancelled or modified within 48 hours of time of service are subject to 50% penalty fee, all reservation cancelled or modified within 24 hours of time of service are subject to 75% penalty fee and all no show reservation are subject to 100% penalty fee.Chevalerio offer a 15-minute grace period past the specified pickup time on all reservations.
The driver/chauffeur has the right to terminate the run for any indiscretion. In the event the reservation is terminated for indiscretion no refunds will be provided and the reservation will be billed in full.
WAIT TIME
For airport departures or transfer we offer a 15-minute grace period past the specified pickup time on the reservation. Wait Time will apply after the grace period expires at the requested vehicle service rate billed in 15-minute increments. After 45 minutes of Wait Time the reservation will convert to an hourly reservation and the charges will be adjusted accordingly. It's up to the driver to wait or continue for his next pickup.
AIRPORT ARRIVALS
In order to establish contact, passengers need to have their mobile phone turned on upon arrival. CHEVALERIO is not responsible if the passenger is unreachable after arrival. If the passenger is unable to locate their vehicle or unable to find Airport Customer Service Counters, they must contact CHEVALERIO at +1 718-650-7636. Failure to establish contact within 30 minutes for domestic arrivals or 45 minutes for international arrivals may result in additional Wait Time or a No-Show charge. Clients are provided 30 minutes courtesy wait time to pick up luggage for domestic arrivals and 45 minutes for international arrivals.
Should luggage be lost or other delay occur it is the passenger’s responsibility to contact our office immediately. The booker or passenger must indicate if luggage or equipment will require special handling. CHEVALERIO is not responsible for shipping if your equipment does not fit into the requested vehicle type listed on the confirmation. Should any passenger need more than 30 minutes to pick up luggage (e.g. golf bags), please account for that at the time of booking your reservation to avoid any additional charges. CHEVALERIO is not responsible for delays resulting in a Late Cancel or No Show. If contact has not been made after the courtesy Wait Time has elapsed the reservation will be considered a No Show and charges will apply which is equal to the base fare of the reservation plus all applicable fees.
DRIVER/CHAUFFEURS
Chevalerio reserves the right to offer discounts to its customers to prove the loyalty of all drivers. Chevalerio will ask its clients from time to time to convince their designated driver to do work outside of CHEVALERIO. Any driver who is not loyal to the platform will be automatically terminated without any further notification/explanation and without the right to use the application or any future product or service from CHEVALERIO as a driver or client. CHEVALERIO expects each and every one of the drivers to be impeccable (EX: White shirt on black pants and suit preferably) when offering their services, drivers who do not comply with this regulation will be automatically terminated without any further notification/explanation and without without the right to use the platform or any future products or service from CHEVALERIO as a driver or client.
DRESS CODE
Chevalerio reserves the right to require each and every drivers to dress formally (black white shirt not mandatory but preferably). Since driving is one of the most important job in New York City you should dress to impress our clients
Changes to This Terms and Conditions
waitAround LLC may update Chevalerio Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. Chevalerio will notify you of any changes by posting the new Terms and Conditions on this page.
